Welcome to our portal, this portal which includes the Website and the app (“Portal”) is provided by Ansari Group of Company (“AGC”) as a service to our customers (“Customer, You, Your”) wishing to benefit from the following services which are subject to change from time to time at AGC’s discretion (“Services”) through the Portal: 1) inquire about our portfolio of properties (“Properties”) 2) lease the Properties, pay rents/ service charges/ penalties, etc. related to Properties 3) renew lease agreement (‘Lease Agreement”) related to Properties 4) receive all communications related to the Properties rented to them such as without limitation: circulars, notifications of service interruptions, planned maintenance activities, etc. 5) Upload their KYC documents such as passport copies, visa pages, EID, Trade license, etc. as required 6) Change and update their contact details 7) and any other Service that may be added to the Portal from time to time.

Please note that your use of the Portal’s Services constitutes your agreement to follow and be bound by these terms and conditions (“Terms and Conditions”) which are in addition to :1) the conditions stated in the Lease Agreement 2) any third party license terms (such as open source software) 3) the conditions dictated by any third party involved in the payments procedures 4) our Privacy policy which you can access through the Portal. Please read these Terms and Conditions carefully and request to read/get copy of any terms to ensure that you have full acknowledged of all terms governing your usage of the Portal.

By using this Portal and using any of the Services provided through this Portal you hereby confirm that you abide by the Terms and Conditions. AGC reserves the right to change the Terms and Conditions at any time to the extent permitted by law. Any such changes will take effect when posted on the Portal and it is your responsibility to read the Terms and Conditions on each occasion you use this Portal and your continued use of the Portal shall signify your acceptance to be bound by the latest Terms and Conditions. If you do not agree to (or cannot comply with) or do not understand any of the Terms and Conditions please refrain from using this Portal.

If you are registering or using this Portal on behalf of a company or other business entity, you confirm that you have the authority to bind that company or business entity.

AGC reserves the right at its own discretion to make update to the Portal which may vary your experience.

The Customer shall remain responsible for any mobile operator charges and other third parties’ charges.

By using the Services provided through this Portal you acknowledge the binding effect of any acceptance made by you in your own capacity and/or on behalf of any entity through this Portal.

● All communications communicated to you through this Portal will be deemed as duly received by you and unless AGC receives a rejection to the content of such communication addressed to: info@ansarikv.com within 24 hours from being sent to you, such communication shall be deemed as being duly accepted by you.

●You expressly consent to and authorize AGC and its employees, agents, representatives, affiliates, or anyone calling on its behalf for any and all purposes arising out of or relating to Services /portal`s Services/ your account, to contact you in any way, including SMS messages (including text messages), calls using prerecorded messages or artificial voice, and calls and messages delivered using auto telephone dialing system or an automatic texting system, at any telephone number, you provided to AGC, which you certify warrant and represent is/are your own number(s) or you are permitted to receive calls/SMS at each one of these number(s), including through the possible use of automated technology and recorded messages. You agree to promptly alert AGC whenever you stop using a particular telephone number. Your cellular or mobile telephone provider will charge you according to the type of plan you carry. You can Opt-Out from receiving SMS Messages at any time by using the following URL “unsb.co”

● Whenever any necessary notice is required as per the UAE prevailing law, such notice shall be deemed to be received by you at the time such communication is sent to you through the Portal and you hereby irrevocably and unconditionally waive any obligation on AGC to send you such notice through any other means.

● Any acceptance of lease, and/or renewal of lease and/or change of rent and/or change of any term of the Lease Agreement made through the Portal shall be considered as binding;

● Any payment made through the Portal using the Customer’s name and password and/or inserting the details of the Property leased by the Customer’s shall be considered rightful and made by you;

● Usage of the Portal by logging with your user name and password shall be considered as your own usage of the Portal and AGC shall be under no obligation to check the authenticity of such usage as you are solely responsible for keeping your log-in username and password strictly confidential.

● AGC is not responsible to check the identity of the person making a payment through this Portal. Any payment made using a Customer’s user name and/or password and/or inserting a Customer’s information in the relevant section required to undertake the payment, such payment shall be considered as made on behalf of the Customer whose user name and/or password and/or information have been used. If person/entity has made a payment using the Portal and has mistakenly inserted wrong information required for the payment (“Payer”) entailing such payment to be made to the person whose information has been mistakenly inserted (“Beneficiary”), the Payer is to claim for the amount mistakenly paid to Beneficiary from the Beneficiary and shall not be entitled to claim such amount mistakenly paid from AGC.

The Portal can only be used by persons who are above 18 years old.

The Portal is intended for use by residents of the United Arab Emirates. Non-residents can only view properties displayed in the Portal but cannot log in. Non-residents who choose to access this Portal from outside the United Arab Emirates to view properties are responsible for compliance with all applicable laws. The Portal is not to be accessed or used by persons whose registration has been suspended or terminated by AGC for any reason whatsoever.

Use of and access to this Portal is void where prohibited.

You accept to allow us to safeguard in our system in the United Arab Emirates only the information and documents provided by you to us (whether in registration or otherwise) and to disclose such information and documents to the relevant authorities, service providers/subcontractors and jurisdiction if required. If you use the Portal, you are responsible for maintaining the confidentiality of your account, username and password and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account, username or password. AGC assumes no liability to any person for any loss or damage which may arise as a result of any failure by you in protecting your password, username or account, and You shall indemnify and keep AGC, its affiliates, representatives, officers, directors, employees and agents indemnified against any loss, claim or demand in connection with any person’s accesses and use of the Portal via your account, username or password. You must notify AGC of any suspicious activities on your account by contacting us immediately through the following address info@ansarikv.com or Telephone – +971 (0) 50 6789 325. If AGC has a reason to believe that there might be a breach of security or misuse of the Portal, we may require you to change your password or we may suspend your account without any liability to us.

All the information provided by you to us must be true, accurate, current and complete. Providing any untrue, inaccurate, incomplete or not current information constitutes a breach of these Terms and Conditions. You need to notify AGC of any change in the information you have provided to AGC.

You shall not upload via the use of Portal any information, data or materials which infringe any third party’s confidentiality, privacy or other proprietary or intellectual property rights or which violate any applicable law, statute, ordinance or regulation.

You shall not upload via the use of Portal any information, data or materials contrary or inconsistent with the social, cultural or religious norms and standards of the United Arab Emirates.

AGC conducts thorough due diligence on its potential tenants, your acceptance to lease any displayed Property does not mean that your acceptance binds AGC to proceed with concluding any leasing relation with you. AGC’s acceptance to lease the Property to you shall only be considered as binding once a Lease Agreement is issued and duly signed by AGC’s authorized representative. AGC may also require additional verifications and/or documents and/or information from you before accepting to lease the Property to you.

You are solely responsible for understanding and complying with any and all laws, rules and regulations of your specific jurisdiction that may be applicable to you in connection with the payment.

Any payment made through credit card shall be considered as made by you or on your behalf, AGC is not liable to identify the authenticity/owner of any credit card used to undertake any payment through this Portal.

As the payment made by credit card shall will be considered as generated from you, you will be solely liable to compensate any third party who has made payment on your behalf using such third party’s credit card.

You may only pay your rent by credit card if you are the registered tenant under the lease for the relevant premises and you use your own credit card to make the payment. Please note that making payment with another person’s credit card is strictly forbidden and could lead to criminal prosecution.

We currently accept Payment by JCB, Visa, Visa Electron, Maestro and MasterCard provided the credit card has been issued in any of the UAE, Bahrain, Kuwait, Oman, Qatar or Saudi Arabia.

If you pay your rent in bi-annual or quarterly installments (each, an “Installment”), you may submit a standing instruction (“Standing Instruction”) for the payment of such Installments.

If you wish to cancel a Standing Instruction, you must do so at one of our customer service centers at least 7 days prior to the due date of the next Installment.

If you wish to amend a Standing Instruction, you can only do so online in accordance with the instructions on our website. You must make the necessary changes to your Standing Instruction at least 24 hours before the due date of the next Installment.

We may, at our sole discretion, charge you an additional administrative fee for the cancellation of a Standing Instruction.

You may not use, nor cause or permit third party to use or access, the Portal for any unauthorized use or for any illegal or unlawful purpose. It is your responsibility to notify AGC in case you become aware of any unauthorized use of the Portal. Your unauthorized use or violation of these Terms and Conditions may immediately and automatically terminate your right to use and access the Portal and may subject you to legal liability. Appropriate legal action may be taken for any illegal or unauthorized use of the Portal. We may remove any unauthorized content, links, etc. without notice. Some examples of unauthorized, illegal or unlawful use of the Portal include, but are not limited to:

● Accessing data not intended for such user or logging onto a server or an account which the user is not authorized to access;

● Attempting to probe, scan or test the exposure of a system or network or to breach security or authentication measures without proper authorization.

● Attempting to interfere with service to any user, host or network, including, without limitation, via means of submitting a virus to the Portal, overloading, flooding, spamming, mail bombing or crashing.

● Sending unsolicited email.

● Data scraping, Copying, modifying, displaying, performing, distributing, republishing, or retransmitting any content or material (including, by way of example, images and text), in whole or in part, from/on the Portal without our prior written consent.

● Collecting usernames and/or email addresses of users for the purpose of sending unsolicited email

● Using a framing or similar technique without our prior written permission

● Creating or maintaining any link from another Portal to any page on the Portal without our prior written permission.

● Attempting to impersonate another user or person at checkout or otherwise.

● Using the account, username, or password of another user or disclosing your password, as applicable, to any third party or permitting any third party to access your account.

● Using the Portal for any harassing, threatening, libelous, abusive, obscene or privacy-invading purposes.

● Using the Portal in a manner inconsistent with any applicable law, rule or regulation.

● Using or attempting to use any engine, software, tool, agent or other device or mechanism (including without limitation browsers, spiders, robots, avatars or intelligent agents) to navigate or search the content of this Portal other than the search engine and search agents available on this Portal (if any).

When you visit the Portal or send emails to AGC, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by email or by posting notices on the Portal. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

AGC’s records/statements regarding payments made through the Portal shall be considered as conclusive and final.

Unless otherwise noted, all contents of the Portal are copyrights, trademarks, trade dress and/or other intellectual property owned, controlled or licensed by AGC, or one of its affiliates or by third parties who have licensed their materials to AGC and are protected by the applicable laws.

AGC and licensors expressly reserve all intellectual property rights in all text, programs, photos, processes, technology, content and other materials, which appear on this Portal. Access to this Portal does not confer and shall not be considered as conferring upon anyone any license under any of AGC’s or any third party's intellectual property rights. All rights, including copyright, in this Portal are owned by or licensed to AGC. Any use of this Portal or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without the permission of AGC. You may not modify, distribute or re-post anything on this Portal for any purpose.

AGC names and logos and all related service names, design marks and slogans are the trademarks or service marks of AGC. No trademark or service mark license is granted in connection with the materials contained on this Portal. Access to this Portal does not authorize anyone to use any name, logo or mark in any manner whatsoever.

AGC does not accept responsibility for any interference or damage to your electronic devices, programs, data and other stored information if it was damaged by any kind of materials, viruses, cookies or any other electronic damages which arises in connection with Customer’s use of the Portal.

We give no warranties or representations that the Properties information accessible via this Portal is accurate, complete or current.

To the fullest extent permissible by applicable law, AGC disclaim and exclude any express or implied warranties or representations of any kind, including any warranties as to merchantability or fitness for a particular purpose of the Properties, their content and the products and Services listed or leased on or through the Portal nor the Services provided through this Portal.

This Portal is provided on “as is” basis without any warranties of 1) being free from defects 2) be continuously accessible 3) fit for purpose.

You need to know that the Portal is subject to interruptions and there is no guarantee of availability of all the Services at all times.

AGC or any of its affiliates, employees, directors, agents or representatives shall not be liable to you or to any other person for any indirect, special, incidental or consequential losses or damages of any nature arising out of or in connection with the use of or inability to use, or reliance on any content displayed on the Portal, including without limitation damages for loss of profit, accuracy of results, loss or corruption of data, work stoppage, or computer failure. Without prejudice to the generality of the section above, the total liability of AGC to you for all liabilities arising out of or in connection with these Terms and Conditions is it in tort or contract is limited to five thousand Dirhams only.

AGC makes no representations or warranties about the accuracy, reliability, completeness, correctness and/or timeliness of any content, information, software, text, graphics, links or communications provided on or through the use of the Portal or that the operation of the Portal will be error free and/or uninterrupted. Consequently, AGC assumes no liability whatsoever for any monetary or other damage suffered by you on account of the delay, failure, interruption, or corruption of any data or other information transmitted in connection with use of the Portal; and/or any interruption or errors in the operation of the Portal.

AGC or any of its affiliates, employees, directors, agents or representatives shall not be liable to you or to any other person for any direct, indirect, special, incidental or consequential losses or damages of any nature arising out of or in connection with any delay whatsoever.

Our performance under these Terms and Conditions is subject to existing laws and legal process, and nothing contained in these Terms and Conditions is in derogation of our right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Portal’s services, or information provided to or gathered by us with respect to such use. If any part of these Terms and Conditions is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed to be superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of these Terms and Conditions shall continue in effect.
